General Terms and Conditions

These General Terms and Conditions may be modified or updated at any time by Vargas Garage 642, which will immediately notify customers.

Prices displayed

All product prices are clearly displayed on the Site. They do not include shipping costs, which will be clearly displayed before the order is finalized.
 

Production and Shipping Time

From the time all order details have been provided and payment has been received, the average times to produce and ship the items vary from 10 to 15 working days. These times may vary depending on the product, the period or for other causes that in any case will be communicated to the customer at the time of the order. The times for what concerns ready-made products are significantly shorter and vary according to the shipping method selected. 

Invoicing 

Upon specific request of the Customer at the time of the order, it is possible to issue a commercial invoice, which will be sent after the goods are delivered.  

Warranty

Vargas Garage 642 sells exclusively handcrafted products, in many cases at the specific request of the customer. This allows us to provide the highest guarantee of quality and durability. Vargas Garage 642 products are made in full compliance with Italian laws governing labor regulations. 

Privacy

Pursuant to Legislative Decree No. 196 of June 30, 2003 "Protection of persons and other subjects with regard to the processing of personal data" (hereinafter referred to more briefly as "Law") :

PURPOSE OF PROCESSING

  • data processing has the purposes directly related and instrumental to the provision of the requested service
  • moreover, the processing of data will also be carried out for market surveys, sending of advertising material, marketing activities and commercial information related to products and services of companies that are offered on the website, in any way and by any means carried out; survey of the degree of user satisfaction on the quality of products and/or services provided and on the activity carried out by the Company that displays on the website, carried out directly or through the work of specialized companies through personal or telephone interviews, questionnaires, etc.

MODE OF TREATMENT

The data will be processed primarily by computer and electronic means and stored both on computer media and on paper as well as on any other type of suitable media, in compliance with the minimum security measures in accordance with the Technical Specifications on Minimum Security Measures, Annex B of the Code on the Processing of Personal Data.

OPTIONAL NATURE OF DATA ACQUISITION

The acquisition of personal data is optional in nature. However, failure to provide, even partially, the personal data required to complete the Registration Form for Access to the Service may result in the impossibility of proceeding to the full provision of the Service itself.

INDIVIDUALS TO WHOM THEY MAY BE DISCLOSED

Personal data may be communicated to the personnel of the Company, who serve as data controllers and data processors; the personnel have been properly instructed in security and protection of personal data; In any case, the prohibition to communicate or disclose personal data to individuals who are not necessary for the performance of services still applies.

RIGHTS OF THE DATA SUBJECT

With regard to the processing of personal data, pursuant to Article 7 (Right of access to personal data and other rights) of the General Data Protection Regulation, you have the right to obtain confirmation of the existence or non-existence of personal data concerning you, even if not yet registered, and their communication in intelligible form. You have the right to obtain the indication:

  • of the origin of the personal data
  • of the purposes and methods of processing
  • of the logic applied in case of processing carried out with the aid of electronic devices
  • of the identification details of the data controller and data processors
  • of the subjects or categories of subjects to whom the data may be communicated or who may become aware of the data in their capacity as designated representative in the territory of the State, data processors or persons in charge of processing

You have the right to obtain:

  • the update or integration of the data
  • the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including data whose retention is necessary in relation to the purposes for which the data were collected or subsequently processed

You have the right to object, in whole or in part:

  • for legitimate reasons to process personal data about you, even if relevant to the purpose of data collection
  • the processing of personal data concerning you for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communications

In order to exercise the rights provided for in Article 7 of the General Data Protection Regulation, listed above, you must send a written request, without any particular formality, to Vargas Garage 642 - Via Flaminia, 248 - 47924 Rimini (Rn) Italy

Right of Withdrawal

Vargas Garage 642 grants the consumer, who for whatever reason is not satisfied, the right of withdrawal as provided for by current legislation without penalty and without specifying the reason.

This right can only be exercised by consumers, so all purchases made for purposes not unrelated to the business or professional activity, i.e. where a VAT reference is entered in the order form, do not have this right.

The deadline for exercising this right is 10 working days from receiving the goods, within which the Customer must return the goods and notify us by registered letter to the address:

If the right of withdrawal is manifested by fax or by e-mail through our contact form, it must still be confirmed by registered letter to the above address, within the next 48 hours.

Please note. In the letter requesting to exercise the right of withdrawal, it is necessary to indicate the details of a bank or postal account in order to refund the amount due (CIN Code, ABI Code, CAB Code, Account Number, Account Holder).

To make use of the right of withdrawal it is necessary that:

  • the Customer expresses his willingness to exercise the right of withdrawal in the manner described above
  • the purchased property is unused, undamaged and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment);
  • the product is returned in the time and manner described above. The costs of return shall be paid by the Customer himself. It is understood that the consumer is fully responsible for the risks of transportation for the return of the items. 

Vargas Garage 642 is not liable in any way for damage or theft/loss of goods returned by uninsured shipments. Under no circumstances will cash-on-delivery or freight collect packages be collected.

After checking the integrity of the goods, we will refund you the amount already paid by bank transfer to the account you have communicated to our Customer Service.

The amount refunded will cover only the price of the product and will be made no later than 30 days from the time the goods for which you wish to exercise the right of withdrawal are returned to us.

The only costs to be paid by the Customer are those related to the return of the product.

WHEN THE RIGHT OF WITHDRAWAL IS FORFEITED

The right of withdrawal is forfeited in cases where Vargas Garage 642 determines:

  1. Even partial use of the good;
  2. The lack of the original outer packaging and/or inner packaging;
  3. The lack of the original outer packaging and/or inner packaging;
  4. The damage of the product for causes other than its transport.

In the above cases, Vargas Garage 642 will return the purchased goods to the sender, charging the sender for the shipping costs.

Product Delivery

Vargas Garage 642 delivers its products within the Italian National Territory, the Republic of San Marino, the Vatican City, all countries of the European Union and the rest of the world.

Shipping costs

Shipping costs are calculated based on the destination and vary according to factors that are indicated to the customer when completing the order.

Courier Used

The couriers used by Vargas Garage 642 are SDA and Mail Boxes Etc. 

Payment Methods

Vargas Garage 642 accepts the following payment methods:

Credit Card Payments through X-Pay

Xpay is the fast, reliable and innovative way to pay.  All major credit cards and prepaid cards are accepted. Your financial information will not be shared with Vargas Garage 642 but will be handled directly by X-Pay.

If the customer cancels the order or if the product purchased on the Vargas Garage 642 website is not available, the amount will be refunded.

Vargas Garage 642 will not be responsible for delays or damages caused in the refund process.

Obligations of the buyer

It is forbidden for the buyer to enter false and / or fictitious data in the registration process necessary to activate the process for the execution of this contract and further related communications; personal data and e-mails must be only your real personal data and not those of third persons or fictitious.

The consumer and/or customer authorizes Vargas Garage 642 and agrees to provide, at the discretion of the latter's request, copies of unexpired identification documents.

Failure to comply with the request for documents authorizes Vargas Garage 642 to terminate the contract for default by the purchaser.

The customer releases Vargas Garage 642 from any liability arising from issuing erroneous tax documents due to errors related to the data provided by the Customer, the Customer being solely responsible for their correct entry.

The customer agrees, once the online purchase procedure is completed, to print and keep these general terms and conditions, which he/she will have already viewed and accepted as a mandatory step in the purchase, and to print the specifications of the product being purchased.

The guarantee of the successful completion of the payment that the customer makes by the above means is essential, so that by express agreement the customer's failure to comply with this obligation will result in the legal termination of the contract without the need for judicial ruling, without prejudice to the right of Vargas Garage 642 to take legal action for compensation for further damage.
 

Contract termination and Express termination clause

Vargas Garage 642 has the right to terminate the contract entered into by giving simple notice to the consumer and / or customer with adequate and justified reasons, in which case the customer will be entitled only to a refund of any amount already paid.
